Important Information for Candidates and PACs
Act 2012-461, which imposes requirements regarding automated telephone calls, has been precleared
by the U.S. Justice Department. The new law requires, in part, that automated or pre-recorded
phone calls for political advertisements must be clearly identified as a paid political advertisement
at the end of the call and also identify which entity has paid for that communication. The law also
makes it unlawful to misrepresent the identification of the entity making the automated phone call
for purposes of political advertising.
